Terms of Service

These Terms of Service are a contract between you and Penny Labs LLC. If you're agreeing on behalf of a business, you confirm you're authorized to bind it. If you don't agree, please don't use Penny.

You're responsible for your account, for keeping your login secure, and for everything that happens under it. Give us accurate information and keep it current. You must be at least 18 and able to enter into a contract.

Penny answers calls and website chats, books appointments, captures leads, and notifies you, following the settings you configure. You decide how Penny greets callers and what it can do. You're responsible for the configuration you choose and for telling your callers that calls may be answered and recorded by an automated assistant where the law requires it.

Don't use Penny to break the law, to harass or defraud, to send spam, or to handle calls you aren't authorized to handle. Don't try to disrupt, reverse-engineer, or overload the service. We may suspend an account that puts the service, its users, or the public at risk.

Paid plans and usage are billed as described on our pricing page and in your dashboard. Subscriptions renew automatically until you cancel; usage above your plan and any auto-recharge top-ups are billed as you go. We refund your first paid month if you do not want to continue after trying Penny. Contact support to request that refund. Other fees are non-refundable except where required by law. You can cancel any time and keep access through the end of the period you've paid for.

You own your data. We handle it under our Privacy Policy and Data Processing Addendum, and only to provide the service. You grant us the limited rights we need to run Penny for you.

Penny works with services you connect (like your calendar) and providers we rely on for telephony, hosting, and payments. Their terms apply to their parts, and we aren't responsible for services we don't control.

We work hard to keep Penny reliable, but the service is provided "as is" without warranties of any kind, to the fullest extent the law allows. Penny is an automated assistant and can make mistakes; it isn't a substitute for emergency services or professional advice.

To the extent permitted by law, neither party is liable for indirect or consequential damages, and our total liability for any claim is limited to the amount you paid us in the three months before it arose.

We may update these terms; if a change is material we'll give you reasonable notice. You can stop using Penny any time, and we may suspend or end accounts that violate these terms. Questions? Email support@pennyassistant.com.
